The Government issued Decree No. 21/2024/NĐ-CP amending and supplementing some provisions of Decree No. 51/2016/NĐ-CP dated 13/6/2016 and Decree No. 52/2016/NĐ-CP dated 13/6/2016 regulating salaries, remuneration, and bonuses for managers of limited liability companies with 100% State-owned capital. The Decree is effective from 10/4.
Regarding salary scales, pay tables, and allowances for employees working in State-owned enterprises, Decree No. 21/2024/NĐ-CP states that salary scales, pay tables, and allowances are used as the basis for salary classification, payment, and implementation of labor rights according to labor laws.
The salary levels in the pay scales, pay tables, and allowances are determined by the company but must ensure that the salary fund does not exceed the planned salary fund of the employees as stipulated.
When establishing or amending the salary scales, pay tables, and allowances, the company must consult the opinions of labor representatives at the grassroots level, hold dialogues at the workplace as required, report to the ownership representative agency for approval, and publicly disclose at the company before implementation.
Additionally, Decree No. 21/2024/NĐ-CP also amends and supplements points a and b of Article 5, Clause 3 of Decree No. 51/2016/NĐ-CP regarding the determination of the planned salary fund.
When determining the planned salary fund, the company excludes objective factors affecting labor productivity and profit compared to the previous year.
Regarding salary classification for managers and specialized control inspectors, based on the organizational structure, the Board of Directors or Chairman of the company issues salary tables and classifies salaries for managers and specialized control inspectors as the basis for implementing social insurance, health insurance, unemployment insurance, and other regimes as stipulated by labor laws.
The salary levels in the pay tables are determined by the Board of Directors or Chairman of the company but must ensure that the salary fund based on the pay tables does not exceed the planned salary fund of managers and specialized control inspectors as stipulated.
When establishing or amending the pay tables for managers and specialized control inspectors, the Board of Directors or Chairman of the company must consult the opinions of labor representatives, hold dialogues at the workplace, report to the ownership representative agency for approval, and publicly disclose at the company before implementation.
